These Terms of Service ("Terms", "Agreement") constitute a legally binding contract between you ("Merchant", "User", "you") and MyTshirt ("App", "we", "us", or "our", operated by smilingoat / Ben Baler). By installing, accessing, or using the MyTshirt web application, Wix App Market integration, or embedded storefront widget (collectively, the "Service"), you agree to be bound by these Terms.

If you are agreeing to these Terms on behalf of a company, organization, or other legal entity, you represent and warrant that you have full legal authority to bind that entity.

2. Description of the Service

MyTshirt is an instant print-on-demand merchandising solution designed for websites and Wix-powered storefronts. The Service enables Merchants to:

  • Upload logos, illustrations, or custom slogan text to automatically generate product mockups across apparel, drinkware, accessories, and home goods.
  • Embed customizable, responsive merchandise showcase widgets into their websites.
  • Direct interested buyers to secure, localized Zazzle storefronts for manufacturing, payment, and worldwide delivery.
  • Earn Zazzle Ambassador Program referral commissions or connect dedicated custom Zazzle store accounts.

3. Intellectual Property Rights & Merchant Content License

A. Merchant Retains Full Ownership: You retain all copyright, trademark, and intellectual property rights in and to any logos, images, slogans, graphics, or branding materials you submit or display through the Service ("Merchant Content").

B. Limited License to MyTshirt & Zazzle: Solely for the purpose of operating the Service, rendering product mockups, displaying store widgets, and fulfilling ordered merchandise, you grant MyTshirt and our manufacturing partner Zazzle a worldwide, non-exclusive, royalty-free, limited license to host, scale, reproduce, and display your Merchant Content.

C. Content Representations & Warranties: You represent and warrant that:

  • You own or possess all necessary rights, licenses, consents, and permissions to use and authorize the reproduction of your Merchant Content.
  • Your Merchant Content does not infringe, misappropriate, or violate any third-party copyright, trademark, privacy, publicity, or proprietary right.
  • Your Merchant Content does not contain hate speech, defamatory material, unlawful content, or imagery that violates applicable regional laws.

4. Global On-Demand Fulfillment & Customer Orders (Zazzle)

Physical manufacturing, print quality, shipping, packaging, returns, and customer service for all purchased merchandise items are handled on-demand by Zazzle Inc.:

  • Transactions: All financial transactions, credit card processing, sales taxes, and customer billing are executed on Zazzle's secure checkout infrastructure.
  • Customer Guarantees & Returns: Purchases are subject to Zazzle's 100% Satisfaction Guarantee, return policies, and manufacturing timelines.
  • Pricing & Availability: Product base prices, international shipping rates, and currency conversions are determined according to Zazzle catalog pricing and live exchange rates.

5. Zazzle Ambassador Program Earnings

Merchants who input a valid 18-digit Zazzle Ambassador ID may receive a 15% referral commission on qualifying Cross-Promotion sales routed through their widget. Earnings, referral tracking, minimum threshold payouts, and tax compliance are administered directly through the Merchant's registered Zazzle Ambassador account.

6. Subscriptions, Premium Features & Billing

MyTshirt offers both a Free Plan and upgraded Premium Plan subscriptions ($6.99/month or $5.83/month billed annually):

  • Free Tier: Enables display of up to 6 products with standard widget styling and MyTshirt branding badge.
  • Premium Plan: Unlocks display of up to 60 products, 100% white-label store branding (watermark removal), sales pop-up widget, custom Zazzle store name linking, and advanced analytics.
  • Billing Terms: For merchants installing via Wix, Premium subscription fees are processed and invoiced directly through Wix Billing under Wix App Market subscription terms.

7. Acceptable Use & Prohibited Activities

You agree not to:

  • Reverse engineer, decompile, or attempt to extract the source code of the MyTshirt application.
  • Circumvent or tamper with subscription paywalls or licensing checks.
  • Use the Service to transmit viruses, malicious code, or engage in automated denial-of-service activities.
  • Impersonate any person, brand, or entity without authorization.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MYTSHIRT, SMILINGOAT, OR ITS OPERATORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS REPUTATION) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO MYTSHIRT IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless MyTshirt, its developer, partners, and affiliates from and against any third-party claims, liabilities, damages, and expenses (including reasonable legal fees) arising from your Merchant Content or violation of these Terms.

11. Termination

You may terminate this Agreement at any time by uninstalling the MyTshirt application from your website. We reserve the right to suspend or terminate access to the Service for accounts that violate these Terms or infringe third-party intellectual property rights.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any dispute arising under these Terms shall be resolved in the competent state or federal courts of Delaware.
